Legal notice provided in accordance with the „DATA PROTECTION AND PRIVACY CODE“, an Italian legislative decree issued on June, 30 2003
Pursuant to article 13 of legislative decree Nr. 196/2003 of June, 30 2003, on the protection of personal data relating to individuals and other subjects, we wish to inform you that Hotel Akelei, seated in Reischach/Bruneck, Burgstrasse 7, shall only process data relating to clients, business partners, suppliers and other parties which are voluntarily provided to us (by telephone, fax or e-mail). Said personal data shall be processed in compliance with the provisions of legislative decree Nr. 196 and of our own principles of confidentiality and professionalism. All personal data acquired by our company are disclosed to us either directly by our clients or by third parties carrying out operations such the acquisition of data for commercial information, market surveys and direct marketing of products and services. In case of data collection from external sources, communication is given upon data registration or upon the first contact acquisition at the latest. Our company, for the purpose of supplying services to its clients, may obtain information of so called „sensitive“ nature. According to the law, sensitive data may only be processed if explicit consent has been given by the data subject.
Purpose and goals of personal data processing:
Performance of legal obligations, imposed by statutory orders, Community rules as well as by civil and fiscal provisions. Fulfilment of possible contract obligations towards the data subject. Inspection and control of the technical efficiency of the system. Provision of operations and services connected with our business activity and drawing up of internal statistics for billing, accounting and double-entry bookkeeping purposes. Commercial purposes such as the circulation of business information and advertising material (by post, fax or e-mail), marketing and market research. Protection of claims and management of liabilities. Purposes related to insurance matters, in particular credit insurance. Customer satisfaction enquiries about the quality of the products and services provided by our company which may be conducted by ourselves or by specialised companies by means of personal interviews or telephone surveys, questionnaires etc.
Methods of personal data processing:
For the purposes indicated in the previous paragraph, personal data are processed both manually and using electronic or other telematic media in compliance with the provisions of the above-mentioned paragraphs, constantly ensuring that data security and confidentiality are observed.
With regard to the above-mentioned objectives, your personal data will be shared, upon request, with:
Public administrative bodies and authorities, where provided by law; credit institutes our company has business relations with for the management of claims/liabilities or for the allocation of funds; any natural and/or legal, public and/or private subjects (legal firms, administrative bodies, fiscal consultants, courts, chambers of commerce etc) provided that the transmission of data is necessary for the exercise of our business activity and is carried out in the manner and for the purposes here above stated. By law provisions, any of the above-mentioned subjects your data may be shared with shall use them as “owners”, in complete independence, as they are not involved in the original data processing performed by our company.
Disclosure:
None of the personal data processed by our company is subject to disclosure and dissemination.
Data processing:
The processing of personal information can occur by means of electronic and automated media and it encompasses some of the data processing procedures provided for by art. 4, paragraph 1 (a) of legislative decree Nr. 196 of June, 30 2003. In any case it shall be executed in observance of all cautionary measures aiming at guaranteeing data security and confidentiality.
Rights of the data subjects:
The privacy code provides that data subjects may exercise some specific rights pursuant to art 7 thereof. In particular, data subjects shall have the right to enquire about the existence of their personal data and to be given comprehensive information thereabout. In addition, data subjects shall have the right to obtain further information about the origin of disclosed data, the purpose of data processing and the method thereof, and the system applied in case of electronic data processing. Furthermore, data subjects shall have the right to obtain information about the holder of their data, the subject responsible for the processing thereof, and the persons and/or categories of persons to whom data can be transmitted. Data subjects shall have the right to amend, complete and check their data and to demand that such information be deleted, blocked or made anonymous whenever its processing violates legal regulations. Data subjects may have legitimate reasons and the right to refuse, in part or entirely, the processing of their personal, even if it respects the purpose of data collection; they shall be entitled to do so, even without any specific legitimate reason, when data are used for the circulation of business information, advertising material, direct marketing or market research. The rights herein stated may be asserted by the data subjects themselves or by any other subjects appointed to that purpose sending a registered letter or an e-mail to the address of Hotel Akelei, Burgstrasse 7, Reischach/Bruneck and addressing their request to the person in charge, Mr Wilhelm Bierbauer.

Hotel Akelei with registered office in Reischach/Bruneck, Burgstrasse 7, in the person of its legal representative, Mr Bierbauer Wilhelm. The company reserves the right to modify and integrate this advisory note at any time, in particular in case of subsequent law amendments or new regulations.
E-mail addresses that may be entered into our home page and made publicly available
The users of the home page of Hotel Akelei are expressly notified that any e-mail addresses published on our home page shall not be considered „public data“ within the meaning of the provisions issued by the privacy guarantor on March, 7 2001 and March, 20 2002 and pursuant to the data protection and privacy code (legislative decree Nr. 196/2003). As a result, any e-mail address published on the home page of Hotel Akelei shall only be used for the transmission of any kind of information after prior consent by the subject concerned (see the newsletter of data protection authorities dated February, 10 and 16 2003). Moreover, pursuant to art. 130 of legislative decree 196/2003 it shall be made clear that the use of automatic calling systems, unassisted by human resources, for the circulation of advertising material or for direct marketing/ market research and promotional campaign purposes shall only be allowed after prior consent by the subject data. The provisions of paragraph 1 shall also be applied to all electronic communications which are sent, for the aims described above, by e-mail, fax, as MMS (Multimedia Messaging Service) or SMS (Short Message Service) messages or any other kind. Therefore, it is only after receipt of the consent by the data subject that the users of the home page of Hotel Akelei shall be allowed to use his/her e-mail address for purposes such as the circulation of advertising material, direct marketing operations, the execution of market surveys and of promotional campaigns. As a result, any responsibility of Hotel Akelei for the illegal behaviour of users is to be excluded.
